GENERAL RENTAL CONDITIONS AND CONSENT TO THE PROCESSING OF PERSONAL DATA
IMPORTANT - READ THE GENERAL RENTAL CONDITIONS
The renter (customer) of bicycles and/or equipment from the rental company Imperia Green S.r.l.s. (lessor), whose signature appears on this contract, takes delivery of the bicycle and/or equipment, under the clauses and conditions set out on the back or back of this contract, which the renter accepts and undertakes to respect:

  1. To obtain the rental of a bicycle and/or equipment, the customer must present the lessor with a valid identity document. The bicycle and/or equipment must be returned in accordance with the times communicated and/or posted at the rental point, in the same place where it was rented, unless otherwise agreed in writing.
  2. Before taking possession of the vehicle and/or equipment, the renter must make payment according to the rates in force at the time of rental. The lessor may authorize payments upon return or with other deferrals.
  3. The lessee must pay a security deposit set at € 100.00 (one hundred/00 euros) as a guarantee; this deposit must not be confused with the rental payment; the security deposit may be replaced by the deposit of a suitable guarantee document.
  4. The customer and the lessor will check the functionality of the bicycle and/or equipment upon delivery. Upon taking delivery of the bicycle and/or equipment, the customer acknowledges that it is mechanically efficient and declares that he has previously checked it.
  5. The bicycle and/or equipment is to be used exclusively as a means of transport and must be treated with care, common sense and diligence; competitions, reckless maneuvers and displays of any kind are prohibited. The user must use the vehicle in such a way as to avoid damage to it and its accessories.
  6. It is forbidden to use the bicycle and/or equipment to carry out commercial activities, nor is it possible to transfer it for use to other parties.
  7. The user must comply with the rules of the highway code, rules that he declares to know. The lessor declines all responsibility in the event of improper use of the vehicle and failure to comply with the rules of the highway code.
  8. The use of the bicycle and/or equipment presupposes the physical fitness and technical expertise of the person intending to drive it. Therefore, the user, by renting the bicycle and/or equipment, declares to be equipped with adequate capacity and appropriate expertise, without making any reservations.
  9. Any fact, damage or injury resulting from the circulation and use of the bicycle and/or equipment is attributable only to the user driver. The customer is therefore responsible for damage caused during the use of the vehicle to himself, to third parties, to things, to the bicycle and/or equipment. The lessor cannot be asked for any form of compensation. For example, some costs: Front or rear wheel citybike €60.00; Chain €25.00; Tire €35.00; Inner tube €10.00; Brake lever citybike €25.00; Pedal €15.00; Crank €25.00; Saddle €35.00; lock €15.00; Basket €15.00;
  10. In the event of damage and/or breakages caused to the rented vehicle, the user will have to pay for the damages caused which will be quantified by the lessor upon return of the vehicle.
  11. In the event of theft of the bicycle and/or equipment, failure to return it or irreparable damage to it, the user will have to compensate for the damage with the minimum sum established and agreed upon from now of: € 150.00 (one hundred and fifty euros/00) for children's bikes, seats and other accessories; € 300.00 (three hundred/00) for the child trailer; € 350.00 (three hundred and fifty/00) for City Bikes; € 1000.00 (one thousand euros/00) for E-Bikes, Tandems and Races; € 3500.00 (three thousand five hundred euros/00) for 2-seater Rickshaws, E-Bikes PRO; €4000.00 (four thousand/00) for the 4-seater Rickshaw; €7,000.00 (seven thousand/00) for the 6-seater rickshaw, €5,500.00 (five thousand one hundred/00) for the 2-seater Electric Rickshaw, €6,000.00 (six thousand/00) for the 4-seater Electric Rickshaw, or other commercial value of the goods, which must be paid upon collection of the identity document.
  12. The use of the bicycle is reserved for adults unless the minor is accompanied by an adult who assumes responsibility for him.
  13. The lessor may refuse to rent the bicycle to a person deemed not capable of driving it (pursuant to Articles 186 and 187 of the Highway Code) or for other reasons and in any case at the sole discretion of the lessor himself.
  14. The customer with a non-functioning bicycle or equipment may change his vehicle with another functioning one at any other rental point, both to be able to continue the rental, both to reach the site where the vehicle was initially rented. The rental contract does not provide for the recovery of the vehicle, which will be replaced exclusively at an Imperia Green S.r.l.s. rental point, nor that of the user, who therefore undertakes to return the vehicle to the Imperia Green S.r.l.s. point where the rental contract was signed.
  15. The signing of the rental contract by the user presupposes knowledge and unconditional acceptance of these regulations, rates, opening and closing times of the rental services.
  16. The court of Imperia shall have jurisdiction over any dispute arising from the relationships governed by these general rental conditions.

CONSENT TO THE PROCESSING OF PERSONAL DATA
Pursuant to articles 13-14 of EU Regulation no. 679/2016, the following information is provided. The personal data transferred in relation to the rental agreement concluded with the lessor will be processed in accordance with the provisions of EU Regulation no. 679/2016. Such data will be processed for the following purposes: Conclusion, execution and management of the obligations arising from the rental agreement; fulfillment of legal obligations and/or provisions of public bodies, in particular for the purposes of safety and security in the workplace. The processing will also be carried out with the aid of electronic and automated means. The provision of data is optional, however failure to provide it could make it impossible to fulfill the obligations arising from this contract. The data, always within the scope of the aforementioned purposes, may be communicated to parent companies of, controlled by and/or connected even indirectly, or public administrations, to banking institutions for the purpose of fulfilling the obligations arising from this contract. The data controller is the lessor.
